General Terms and Conditions – Kado in Huis V.O.F.

These general terms and conditions apply to all offers, purchases, and agreements of Kado in Huis V.O.F., both via the webshop and in the physical store.

Article 2 – Definitions

In these terms and conditions, the following definitions apply:

• Company: Kado in Huis V.O.F.
• Customer: any consumer or business customer entering into an agreement
• Agreement: any purchase agreement between Kado in Huis and the customer
• Products: all articles offered by Kado in Huis

Article 3 – Applicability

• These general terms and conditions apply to all offers, orders, and agreements.
• Deviations are only valid if agreed upon in writing.
• General terms and conditions of the customer are expressly excluded.

Article 4 – Offer

• All offers are without obligation, unless stated otherwise.
• Obvious errors or mistakes do not bind Kado in Huis.
• Product images are indicative and may slightly differ from the actual product.

Article 5 – Agreement

• In the webshop, the agreement is concluded at the moment of ordering and confirmation by e-mail.
• In the physical store, the agreement is concluded upon payment at the checkout.
• Kado in Huis reserves the right to refuse orders for serious reasons.

Article 6 – Prices

• All prices are in euros and include VAT, unless stated otherwise.
• Shipping costs will be clearly stated before completing an online order.
• Price changes do not affect already concluded agreements.

Article 7 – Payment

• Payment in the webshop is made via the offered payment methods.
• Payment in the physical store is made in cash or by debit card.
• Orders will only be processed after full payment.

Article 8 – Webshop Delivery

• Kado in Huis aims for fast delivery of online orders.
• Delivery times are indicative and not strict deadlines.
• In case of delay, the customer will be informed as soon as possible.

Article 9 – Right of withdrawal (webshop only)

• The customer has the right to dissolve the online purchase within 14 days of receipt without giving any reason.
• The product must be unused and, if possible, in its original packaging when returned.
• After withdrawal, the product must be returned within 14 days.
• The costs for return shipment are for the customer's account, unless otherwise agreed.

Article 10 – Exclusion of right of withdrawal

The right of withdrawal does not apply to purchases made in the physical store, unless otherwise indicated.

Article 11 – Refund

• After correct withdrawal, the purchase amount will be refunded within 14 days.
• Kado in Huis may wait with a refund until the product has been received or it has been demonstrated that it has been shipped.

Article 12 – Warranty and conformity

• Kado in Huis guarantees that the products comply with the agreement and legal requirements.
• Any defects must be reported within a reasonable period.
• The statutory warranty applies.

Article 13 – Complaints

• Complaints can be reported via e-mail or in the store.
• Kado in Huis aims to handle complaints within 14 days.

Article 14 – Liability

• Kado in Huis is not liable for indirect or consequential damages.
• Liability is limited to the amount of the purchase.
• This limitation does not apply in cases of intent or gross negligence.

Article 15 – Force majeure

• Kado in Huis is not obliged to fulfill its obligations in case of force majeure.
• Force majeure is understood to mean any circumstance beyond the control of the company.

Article 16 – Privacy

Personal data will be processed in accordance with applicable privacy legislation. Please consult the privacy policy on the website.

Article 17 – Applicable law

• Dutch law applies to all agreements.
• Disputes will be submitted to the competent court in the Netherlands.

Article 18 – Amendments

Kado in Huis reserves the right to amend these terms and conditions. The most current version is always available on the website.
